Ms. Valeriya Lutkovska: "A priority of the state has to become not only adoption of the new legislation concerning counteraction to domestic violence, but also its effective implementation"

The Ukrainian Parliament Commissioner for Human Rights declared this thesis during a round table "The Istanbul convention: the movement towards to its ratification by Ukraine", organized by the Committee of the Verkhovna Rada of Ukraine for foreign affairs at the initiative of the chairman of subcommittee for international legal issues and parliamentary control over the implementation of the international obligations by Ukraine Mr. Iryna Lutsenko together with Office of the Council of Europe in Ukraine.

Participants of events exchanged opinions concerning necessity of activization of efforts of parliament and the government in the direction of ratification of the Istanbul convention which is an important condition of introduction of the European standards of fight against domestic violence. The Istanbul convention concerns overcoming and prevention of violence against women both in a peace time, and in a situation of armed conflict. According to experts, its implementation is especially actual right now when the number of internally displaced persons constantly grows in Ukraine, violence level in families of the military increases who came back from the anti-terrorist operation zone.

Delivering a speech Ms. Valeriya Lutkovska informed that issues of protection of women, men against violence in a family remain priority in system of monitoring of observance of human rights on behalf of the Commissioner. So, the analysis of a situation which is carried out by the Ombudsman's Office during 2013-2014 concerning violation of the rights in connection with violence in a family showed essential gaps in the current Law of Ukraine "On prevention of violence in a family". In particular, the majority of standards of the mentioned Law are directed not on the prevention, but on overcoming of already existing violence consequences; effective mechanisms of fight against concrete cases of violence in a family aren't elaborated; inadequate is a condition of assistance to the persons affected by physical, psychological, sexual or economic abuse in a family. Also the issue of passing of correctional programs by the persons who committed violence in a family isn't settled.

"The principles laid down in the Istanbul convention allow to look at a situation of domestic violence, violence against women, as serious violation of a human right, in particular the right for life, safety, freedom, dignity, physical integrity. Now the state is on the threshold of difficult work in the direction of ratification of the Istanbul convention. Adoption and implementation of the legislation which would forbid any forms of domestic violence, violence against women has to become a priority, and also ensure appropriate implementation of investigation, justice, protection and support of the victims of such violence", – Ms. Valeriya Lutkovska emphasized.

Besides, according to the Ombudsman of Ukraine, an important task is a vocational training of the experts working with victims of violence or with the persons who committed violence against women and domestic violence.
