Mechanisms of protection of the rights of persons who remained in custody in places of detention in Ukraine demand further improvement

Representatives of the UN Subcommittee on prevention of tortures and other cruel, inhuman or degrading treatment or punishment came to such conclusion during a working meeting with the staff of Department for realization of the national preventive mechanism of the Secretariat of the Commissioner for Human Rights which was held on May 26, 2016 in the Office of  Ombudsman. Exchanging opinions, the international and domestic experts discussed conditions of custody of people in places of detention in Ukraine, and also a guarantee of their protection against tortures and ill treatment.

As members of mission of the UN Subcommittee noted in their speeches irrespective of the fact how often there are cases of ill treatment of people in places of detention, the state has to undertake all possible measures for their prevention. Monitoring visits of places of detention by independent experts have the constraining impact on government bodies and, respectively, minimize risk to become a victim of ill treatment and tortures.

During monitoring visits to places of detention we draw attention to inherent human rights violation having system character for each separate type of places of detention. Such approach helps to reveal the existing shortcomings of normative legal acts and to establish what protective mechanisms need improvement. Through studying positive and negative practice of NPM we aspire to strengthen the existing protective mechanisms and to eliminate or minimize opportunities for abuses", – the representative of Department for realization of the national preventive mechanism Ms. Kateryna Chumak emphasized.

At the end of the working meeting representatives of the Subcommittee on prevention of tortures noted that their organization together with national preventive mechanisms which exist in many countries of the world at the international and national levels ensure protection of the rights of persons who remain in custody in places of detention. In Ukraine these mechanisms need further improvement, in particular, there is a necessity for development of effective techniques of ensuring implementation of recommendations of NPM. Members of mission expressed readiness in every possible way to assist employees of the Secretariat of the Commissioner in their activity.
